Welcome to Sittrly (“Sittrly,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Sittrly website, platform, and related services (“Services”). By using Sittrly, you agree to these Terms. If you do not agree, do not use our Services.
These Terms apply to both families and sitters who use the Sittrly platform.
1. Eligibility
To use Sittrly, you must:
– Be at least 18 years old
– Reside in the United States
– Provide accurate, truthful account information
– Use the platform for lawful purposes only
Sitters must meet Sittrly’s minimum criteria, including background screening and CPR certification.
2. Accounts and Responsibilities
When creating an account, you agree to:
– Provide accurate and updated information
– Maintain the confidentiality of your login credentials
– Be responsible for all activity under your account
– Notify us of unauthorized access
You are responsible for securing your own devices.
3. Nature of the Sittrly Platform
Sittrly is a platform that connects families with independent-contractor sitters. Sittrly does not employ sitters, supervise sitter services, or control how care is delivered.
Sittrly provides scheduling tools, communication tools, payment processing, and background screening coordination. Sittrly does not guarantee the suitability, performance, or availability of any sitter or family.
Sitters are independent contractors responsible for their own conduct, schedules, work quality, and tax obligations.
4. Booking, Fees, and Payments
By booking through Sittrly, families agree to:
– Pay all booking fees, membership fees, and sitter hourly rates
– Provide accurate booking times and care details
– Ensure safe access to the home
– Comply with Sittrly’s cancellation policy
Families acknowledge:
– Sitters set their own hourly rates (with Sittrly minimums)
– A two-hour minimum applies to all bookings
– Overnight “sleep rate” fees apply where stated
– Late cancellations result in sitter compensation fees
Sitters agree to:
– Arrive on time
– Provide safe, attentive childcare
– Track hours accurately
– Follow Sittrly guidelines and professionalism standards
Payments are processed through a secure third-party service. Sittrly does not store full payment card details.
5. Cancellation Policy
Cancellations must follow the Sittrly Cancellation Policy.
Cancellations made within 24 hours of scheduled start time will result in a $25 compensation fee paid to the sitter.
Sitters must notify families immediately if they cannot fulfill a booking. Families & sitters must cancel through the Sittrly platform.
6. Safety and Conduct
All users agree to maintain a safe, respectful environment. You may not:
– Harass, threaten, or abuse sitters, families, or children
– Leave children unattended
– Allow unauthorized individuals during a booking
– Violate laws or childcare regulations
Sittrly may suspend or terminate accounts that violate safety guidelines.
7. Background Checks and Screening
Sittrly coordinates background checks through third-party providers. However, Sittrly cannot guarantee the completeness or accuracy of any background check and is not responsible for omissions, delays, or errors made by screening companies.
Families are encouraged to communicate expectations and household rules directly with sitters.
8. Disclaimers
You understand and agree that Sittrly:
– Does not supervise sitter services
– Does not guarantee sitter availability, performance, or behavior
– Does not provide insurance coverage for users
– Is not responsible for disputes between families and sitters
– Is not liable for damages or issues arising from sitter services
Use of the platform is at your own risk.
9. Limitation of Liability
To the fullest extent permitted by law, Sittrly is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the platform or sitter services.
Sittrly’s total liability, if any, is limited to the amount paid to Sittrly in the 12 months preceding the claim.
10. User Disputes
Sittrly is not a party to agreements between families and sitters. All disputes must be resolved directly between the parties involved. Sittrly may offer optional guidance but has no obligation to intervene.
11. Prohibited Use
You may not use Sittrly to:
– Violate laws or childcare regulations
– Harass, exploit, or harm users
– Create fraudulent accounts
– Interfere with platform functionality
– Misuse or collect user data
12. Intellectual Property
All Sittrly content, branding, logos, and materials are owned by Sittrly and may not be copied or distributed without permission.
13. Modifications to the Service
Sittrly may update or modify features at any time. These Terms may also be updated periodically. Continued use of the platform means you accept any updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of Tennessee.
